Abstract

Penelitian ini ditujukan untuk mengetahui hak istimewa dan fasilitas bagi penanam modal asing di Indonesia selain itu untuk mengetahui pemerintah dalam memberikan fasilitas kepada penanam modal asing dan penanam modal dalam negeri berdasarkan Undang-Undang No. 25 Tahun 2005 tentang Penanaman Modal. Dalam Pasal 18 sampai degan Pasal 24 UUPM, ditentukan bahwa investor, baik dalam negeri maupun asing yang menanamkan investasinya di Indonesia diberikan fasilitas. Penelitian yang digunakan adalah penelitian hukum normatif. penanam modal asing baru mendapatkan hak istimewa nya apabila ada perjanjian istimewa di Indonesia, dan pemberian hak istimewa juga diberikan kepada penanam modal asing dan dalam negeri apabila telah sesuai dengan kriteria yang telah ditentukan oleh UUPM.
