Parking management as part of public service places local governments in a position that entails not only administrative authority but also the responsibility to ensure that policies and cooperation agreements are legally valid. In Sidoarjo Regency, this issue is particularly relevant to assessing the validity of the cooperation agreement between the Sidoarjo Regency Government and PT Indonesia Sarana Service (ISS) concerning parking management. This study examines the conformity of the agreement with applicable laws and regulations and the legal principles governing the formation and implementation of such agreements. The study employs a normative juridical method using a statutory and conceptual approach. Primary, secondary, and tertiary legal materials are systematically examined to identify the legal basis of local government authority, the requirements for contractual validity, and the relationship between the applicable legal framework and the implementation of parking management cooperation. The findings demonstrate that the validity of the cooperation agreement cannot be separated from the conformity between the authority of the local government, the substance of the agreement, and the legal provisions governing parking management. This legal framework provides the basis for legitimizing cooperation between the local government and private entities while simultaneously limiting the exercise of governmental authority within the boundaries of law. The study argues that the validity of a cooperation agreement concerning parking management constitutes an important mechanism for ensuring that public service policies remain grounded in the rule of law. Accordingly, governmental authority, contractual substance, and compliance with applicable legislation must be understood as interconnected elements in determining the legal legitimacy of such cooperation.
Abstrak
Pengelolaan perparkiran sebagai bagian dari pelayanan publik menempatkan pemerintah daerah pada posisi yang tidak hanya memiliki kewenangan administratif, tetapi juga tanggung jawab untuk memastikan bahwa setiap kebijakan dan kerja sama yang dibentuk memiliki dasar hukum yang sah. Dalam konteks Kabupaten Sidoarjo, persoalan tersebut menjadi penting dalam menilai keabsahan perjanjian kerja sama antara Pemerintah Kabupaten Sidoarjo dan PT Indonesia Sarana Service (ISS) dalam pengelolaan perparkiran. Penelitian ini menganalisis kesesuaian perjanjian tersebut dengan peraturan perundang-undangan yang berlaku serta prinsip-prinsip hukum yang menjadi dasar pembentukan dan pelaksanaan perjanjian. Penelitian menggunakan metode yuridis normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Bahan hukum primer, sekunder, dan tersier dianalisis secara sistematis untuk mengidentifikasi dasar kewenangan pemerintah daerah, persyaratan keabsahan perjanjian, serta keterkaitan antara pengaturan hukum dan pelaksanaan kerja sama pengelolaan perparkiran. Hasil penelitian menunjukkan bahwa keabsahan perjanjian kerja sama tidak dapat dilepaskan dari kesesuaian antara kewenangan pemerintah daerah, substansi perjanjian, dan ketentuan hukum yang mengatur pengelolaan perparkiran. Pengaturan hukum tersebut menjadi dasar legitimasi bagi pemerintah daerah dalam membentuk hubungan kerja sama dengan pihak swasta sekaligus membatasi pelaksanaan kewenangan agar tetap berada dalam koridor hukum. Temuan ini menunjukkan bahwa keabsahan perjanjian kerja sama dalam pengelolaan perparkiran merupakan bagian dari mekanisme untuk memastikan kebijakan pelayanan publik tetap berlandaskan prinsip negara hukum, sehingga aspek kewenangan, substansi perjanjian, dan kepatuhan terhadap peraturan perundang-undangan harus dipahami sebagai satu kesatuan dalam menentukan legitimasi hukum kerja sama tersebut.
