Regulatory Dissonance in Professional Organizations’ Authority to Issue Recommendations and Registration Certificates under the 2023 Health Act

Abstract

The transfer of authority to issue Registration Certificates (Surat Tanda Registrasi or STR) under Law No. 17 of 2023 on Health has reconfigured the institutional relationship between the state and professional organizations in Indonesia’s health-care system. The shift is significant because professional organizations previously exercised an important role in professional registration, whereas the new framework places STR issuance within councils operating under the state’s institutional structure. This transformation raises a broader question concerning whether the regulatory shift merely reallocates administrative authority or fundamentally alters the position of professional organizations in the governance of health professions. Using a normative juridical approach, this study examines legislation, legal doctrine, and theoretical perspectives drawn from political economy, medical ethics, and organizational sociology. The analysis finds that the transfer of STR-issuing authority does not eliminate professional organizations from the regulatory architecture; rather, it produces a functional reconfiguration of their authority. The state assumes greater responsibility for administrative registration and formal professional legitimacy, reflecting its constitutional obligation to protect the public’s right to health. Professional organizations, however, retain substantive authority through ethical oversight, professional development, competency standard-setting through professional colleges, and the protection of health professionals’ interests. The study argues that the regulatory change should therefore be understood not simply as a transfer of institutional power, but as a reconfiguration of regulatory functions between state institutions and professional bodies. Its significance lies in establishing a clearer division of authority that can reconcile state accountability, professional autonomy, competency assurance, and public protection within Indonesia’s health-care governance framework.

 

Abstrak

Perubahan kewenangan penerbitan Surat Tanda Registrasi (STR) melalui Undang-Undang Nomor 17 Tahun 2023 tentang Kesehatan telah mengubah relasi kelembagaan antara negara dan organisasi profesi dalam tata kelola pelayanan kesehatan di Indonesia. Perubahan tersebut menjadi penting karena organisasi profesi sebelumnya memiliki peran signifikan dalam proses registrasi tenaga kesehatan, sedangkan kerangka hukum baru menempatkan penerbitan STR pada konsili yang berada dalam struktur kelembagaan negara. Pergeseran ini menimbulkan persoalan mengenai apakah perubahan tersebut sekadar memindahkan kewenangan administratif atau sekaligus mengubah kedudukan organisasi profesi dalam tata kelola profesi kesehatan. Dengan menggunakan metode penelitian yuridis normatif, penelitian ini menganalisis peraturan perundang-undangan, doktrin hukum, serta perspektif ekonomi politik, etika medis, dan sosiologi organisasi. Hasil analisis menunjukkan bahwa pengalihan kewenangan penerbitan STR kepada konsili tidak menghapus keberadaan organisasi profesi dalam arsitektur regulasi profesi, tetapi menghasilkan rekonfigurasi fungsi dan kewenangannya. Negara memperoleh peran yang lebih besar dalam registrasi administratif dan legitimasi formal tenaga kesehatan sebagai bagian dari tanggung jawab konstitusional untuk menjamin hak masyarakat atas kesehatan. Sementara itu, organisasi profesi tetap menjalankan fungsi substantif melalui pembinaan etika, pengembangan profesi, penetapan standar kompetensi melalui kolegium, serta perlindungan terhadap tenaga kesehatan. Penelitian ini berargumen bahwa perubahan tersebut tidak semata-mata merupakan pengalihan kekuasaan kelembagaan, melainkan penataan ulang fungsi regulasi antara negara dan organisasi profesi. Penataan tersebut penting untuk membangun pembagian kewenangan yang lebih proporsional sekaligus menjaga akuntabilitas negara, otonomi profesi, kualitas kompetensi, dan perlindungan masyarakat dalam tata kelola kesehatan nasional.
