Pappasang, as a source of values and norms within Mandar customary law, faces significant challenges amid the expansion of state law and the dynamics of modernization. This study aims to analyze the position of Pappasang within the structure of Mandar customary law and to examine its interaction with Indonesian positive law through the lens of legal pluralism. Employing a qualitative socio-legal approach, the research draws on textual analysis of Pappasang, in-depth interviews with customary leaders, and field observations in coastal and inland Mandar communities. The findings indicate that Pappasang continues to possess meaningful normative authority, particularly in consensus-based dispute resolution, although it has undergone transformation due to state legal intervention and social change. The study’s distinguishing contribution lies in revealing a process of normative negotiation between customary law and state law, whereby certain Pappasang values are accommodated within formal legal practices but risk being reduced in substantive meaning. This study underscores the urgency of revitalizing Mandar customary law as a living law and proposes a synergistic model between local tradition and modernity for the development of Indonesia’s national legal system.
Abstrak
Pappasang sebagai sumber nilai dan norma dalam hukum adat Mandar menghadapi tantangan serius di tengah penetrasi hukum negara dan arus modernisasi. Penelitian ini bertujuan menganalisis posisi Pappasang dalam struktur hukum adat Mandar serta pola interaksinya dengan hukum positif Indonesia dalam kerangka pluralisme hukum. Penelitian menggunakan metode kualitatif dengan pendekatan sosio-legal melalui analisis teks Pappasang, wawancara mendalam dengan tokoh adat, serta observasi pada komunitas pesisir dan pedalaman Mandar. Hasil penelitian menunjukkan bahwa Pappasang masih memiliki daya ikat normatif yang signifikan, khususnya dalam penyelesaian sengketa berbasis musyawarah, namun mengalami transformasi akibat proses institusionalisasi hukum negara dan perubahan sosial. Temuan pembeda penelitian ini menunjukkan adanya negosiasi normatif antara hukum adat dan hukum negara, di mana sebagian nilai Pappasang terakomodasi dalam praktik hukum formal, tetapi cenderung mengalami penyederhanaan makna. Studi ini menegaskan urgensi revitalisasi hukum adat Mandar sebagai living law serta pentingnya model sinergi antara tradisi lokal dan modernitas dalam pengembangan hukum nasional.
