Keberlakuan Non Refoulement Principle Dikaitkan Dengan Sovereignty Principle: Tinjauan Terhadap Pengungsi Rohingya di Indonesia
Abstract
The study aims to find and analyze the determination of the ethnic status of the Rohingya according to the Refugee Convention and the application of the principle of non-refoulement in the treatment of Rohingyas refugees in Indonesia is linked to the principles of sovereignty. His research method is normative law research, focused on secondary data. The findings show that refugees are aliens who are in the territory of Indonesia because of a justified fear of persecution on the grounds of different races, tribes, religions, nationalities, and political opinions and do not want protection from their country of origin, and refugee status is determined through an administrative process called Refugee Status Determination (RSD) used by the Government or UNHCR to determine whether a person seeking international protection is considered a refugee under international law, and the country of Indonesia as a member of the United Nations (UN) has a responsibility to comply with the principle of non-refoulement in dealing with Rohingya refuges entering its territory, but on the other hand there is also a sovereign principle that affirms that each country also has the right to regulate its internal territory.
