Pengangkatan Wakil Kepala Daerah Tanpa Pemilihan Dalam Perspektif Otonomi Daerah

This study examines the policy of appointing deputy regional heads without direct elections in the Riau Islands Province and analyzes the factors determining its effectiveness in regional governance. Previous studies predominantly emphasize procedural and normative aspects, while the implications for governance effectiveness and local democratic legitimacy remain underexplored. This research employs a normative legal method using statutory and conceptual approaches, focusing on Law Number 23 of 2014 and Law Number 6 of 2020. The findings reveal that such appointments can be normatively justified as an exceptional mechanism within the framework of functional democracy and open legal policy to ensure governmental continuity during leadership vacancies. However, their effectiveness is contingent upon the integration of three key dimensions: clarity of normative authority design, strength of institutional coordination, and political-administrative legitimacy supported by regional legislatures (DPRD). The novelty of this study lies in developing an integrative analytical framework linking normative, institutional, and legitimative factors as determinants of governance effectiveness, moving beyond purely procedural analysis. The study highlights the need for regulatory reform to strengthen the implementation of norms, clarify authority distribution, and ensure that non-electoral appointments remain limited, accountable, and aligned with democratic principles.
Penelitian ini menganalisis kebijakan pengangkatan wakil kepala daerah tanpa pemilihan langsung di Provinsi Kepulauan Riau serta faktor-faktor yang menentukan efektivitasnya dalam penyelenggaraan pemerintahan daerah. Kajian sebelumnya cenderung berfokus pada aspek prosedural dan normatif, sementara implikasi terhadap efektivitas tata kelola dan legitimasi demokrasi lokal masih terbatas. Penelitian ini menggunakan metode hukum normatif dengan pendekatan peraturan perundang-undangan dan konseptual, khususnya terhadap Undang-Undang Nomor 23 Tahun 2014 dan Undang-Undang Nomor 6 Tahun 2020. Hasil penelitian menunjukkan bahwa pengangkatan tanpa pemilihan langsung dapat dibenarkan sebagai mekanisme pengecualian dalam kerangka demokrasi fungsional dan open legal policy guna menjamin keberlanjutan pemerintahan dalam kondisi kekosongan jabatan. Namun, efektivitasnya ditentukan oleh integrasi tiga dimensi utama, yaitu kejelasan desain kewenangan normatif, kekuatan koordinasi kelembagaan, dan legitimasi politik-administratif melalui dukungan DPRD. Kebaruan penelitian ini terletak pada pengembangan kerangka analitis integratif yang menghubungkan faktor normatif, institusional, dan legitimatif sebagai penentu efektivitas pemerintahan daerah, melampaui pendekatan prosedural. Implikasi penelitian ini menegaskan perlunya reformulasi regulasi untuk memperkuat norma pelaksana, memperjelas pembagian kewenangan, serta memastikan bahwa mekanisme non-elektoral tetap terbatas, akuntabel, dan selaras dengan prinsip demokrasi.
