Model Pengembangan Pariwisata Halal Berbasis Maqashid Syariah:Perspektif Hukum Islam dan Regulasi Kebijakan Pariwisata Indonesia

This study aims to construct an integrative legal model for halal tourism development based on maqashid al-shariah within Indonesia’s tourism regulatory framework. The rapid expansion of halal tourism, driven by increasing global Muslim travel demand, has not been accompanied by a harmonized and comprehensive legal system, resulting in fragmented policies and potential legal uncertainty. This research employs a normative-juridical method using conceptual and statutory approaches by analyzing national tourism regulations, DSN-MUI fatwas, and relevant scholarly literature. The findings reveal that existing regulations have not explicitly incorporated the protection of religion, life, intellect, lineage, and property as core principles in halal tourism governance. This study proposes an integrative model grounded in four pillars: regulatory harmonization, national standardization, multi-stakeholder synergy, and sustainability orientation. The novelty of this research lies in the systematic integration of maqashid al-shariah principles with national legal frameworks as an applicable normative model rather than a merely descriptive approach. The study contributes theoretically by strengthening maqashid al-shariah as a normative and evaluative framework in tourism law, and practically by offering policy recommendations to enhance legal certainty, service standards, and global competitiveness of Indonesia’s halal tourism sector.
Penelitian ini bertujuan untuk merumuskan model hukum integratif dalam pengembangan pariwisata halal berbasis maqashid syariah dalam kerangka regulasi pariwisata Indonesia. Pertumbuhan pesat pariwisata halal yang didorong oleh meningkatnya permintaan wisatawan Muslim global belum diimbangi dengan sistem hukum yang harmonis dan komprehensif, sehingga menimbulkan fragmentasi kebijakan dan potensi ketidakpastian hukum. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan konseptual dan perundang-undangan melalui analisis regulasi nasional, fatwa DSN-MUI, serta literatur akademik yang relevan. Hasil penelitian menunjukkan bahwa regulasi yang ada belum secara eksplisit mengintegrasikan perlindungan agama, jiwa, akal, keturunan, dan harta sebagai prinsip utama dalam tata kelola pariwisata halal. Penelitian ini menawarkan model integratif berbasis empat pilar, yaitu harmonisasi regulasi, standardisasi nasional, sinergi multi-aktor, dan orientasi keberlanjutan. Kebaruan penelitian ini terletak pada integrasi sistematis maqashid syariah dengan kerangka hukum nasional sebagai model normatif yang aplikatif, bukan sekadar deskriptif. Kontribusi penelitian ini secara teoritis memperkuat maqashid syariah sebagai kerangka normatif dan evaluatif dalam hukum pariwisata, serta secara praktis memberikan rekomendasi kebijakan untuk meningkatkan kepastian hukum, standar layanan, dan daya saing global pariwisata halal Indonesia.
