Enigma Pemberantasan Korupsi Di Masa Pandemi Covid-19
Abstract
Enigma pemberantasan korupsi di masa krisis sebagaimana pandemi Covid-19 menimbukan berbagai persoalan hukum. Kajian ini termasuk dalam penelitian hukum yang menggunakan pendekatan perundang-undangan dan konseptual. Penelitian hukum ini bertujuan untuk menganalisa enigma dan dinamika kejahatan korupsi di masa krisis; sekaligus mengkaji mengenai hubungan antara pemberantasan korupsi di masa pandemi Covid-19 dengan penyalahgunaan wewenang pejabat publik. Hasil penelitian menyatakan bahwa pemberantasan terhadap tindak pidana korupsi juga dapat menggunakan perspektif Tindak Pidana Pencucian Uang (TPPU). Di sisi lain, kasus korupsi eks Menteri Sosial dan eks Menteri Kelautan dan Perikanan dapat disangkakan telah merugikan perekonomian negara berdasarkan ketentuan Undang-Undang Nomor 31 Tahun 1999 Tentang Pemberantasan Tindakan Korupsi. Sehingga, pada konteks tindak pidana korupsi yang dilakukan oleh kedua eks menteri tersebut, tidak terdapat keraguan untuk menuntut mereka secara maksimal; oleh karena mereka telah melakukan hal-hal yang dapat memberatkan suatu bentuk pidana.
