Abstract


Beverages containing ethanol or ethyl alcohol, commonly referred to as alcoholic drinks or locally known as "Miras," exhibit varying alcohol content levels depending on their type. Despite the distinct definitions of "alcoholic drinks" and "hard drinks," these terms are often interchangeably used by the Indonesian public, leading to a conceptual confusion. Therefore, this research aims to elucidate the role of the Municipal Police (Polisi Pamong Praja) in enforcing Regional Regulation Number 4 of 2009 concerning the Control, Supervision, and Regulation of Alcoholic Beverages in Kendal Regency. The research methodology employed is the Normative Juridical method, with a case study focus on law enforcement by the Municipal Police in Kendal Regency. Data collected encompass information on bars, restaurants, karaoke venues, and/or alcohol providers that fail to meet the requirements stipulated by Regional Regulation No. 4 of 2009. The findings indicate that numerous establishments still do not comply with the prevailing regulations. The Municipal Police's role is observed in two primary dimensions: litigation and non-litigation. In litigation, they engage in the legal enforcement process in accordance with the provisions outlined in the Criminal Procedure Code (KUHAP). Meanwhile, in the non-litigation dimension, they mediate temporary closures of establishments that do not adhere to regulations. The research also identifies inhibiting factors in enforcing Regional Regulation Number 4 of 2009 in Kendal Regency. Consequently, there is a need for an enhanced understanding of the distinctions between "alcoholic drinks" and "hard drinks," and concerted efforts must be made to overcome potential obstacles in enforcing these regulations.
