Analisis Kasus Pemberhentian Hakim Mahkamah Konstitusi Aswanto Oleh Dewan Perwakilan Rakyat

Abstract

ABSTRACT

This research was motivated by the action of the DPR which dismissed Judge MK Aswanto on the grounds that Judge MK Aswanto was said to have annulled a law product of the DPR. This study aims to examine in depth the independence of the judiciary relating to the position of the constitutional court as a judicial institution in Indonesia. In this case it can be seen from the juridical view of the Constitutional Court in Indonesia, and the sociological view which can be seen from the comparison of the constitutional management model with other countries, as well as the philosophical analysis that can be found through the history of the birth of the constitution. The method used in this research is normative research with a library research approach. The results of this study are to find out how far the role of the DPR is in supervising the running of the Constitutional Court and further to answer the legitimacy status of the DPR's actions towards the dismissal of Judge MK Aswanto.

ABSTRAK

Penelitian ini dilatarbelakangi oleh tindakan DPR yang memberhentikan Hakim MK Aswanto dengan alasan karena Hakim MK Aswanto disebut telah menganulir undang-undang produk DPR. Penelitian ini bertujuan untuk mengkaji secara mendalam mengenai independency of judiciary yang berkaitan dengan kedudukan mahkamah konstitusi sebagai Lembaga peradilan di Indonesia.  Dalam hal ini dapat dilihat dari bagaimana pandangan yuridis mengenai Mahkamah Konstitusi di Indonesia, dan pandangan sosiologis yang dapat dilihat dari perbandingan model manejemen konstitusi dengan negara lain, serta analisis filosofis yang dapat ditemukan melalui sejarah lahirnya konstitusi. Motode yang digunakan dalam penelitian ini adalah penelitian normatif dengan pendekatan Library Research atau penelitian kepustakaan. Adapun hasil dari penelitian ini adalah untuk mengetahui seberapa jauh peran DPR mengawasi jalannya Mahkamah Konstitusi dan lebih lanjut untuk menjawab status legitimasi perbuatan DPR terhadap pemberhentian Hakim MK Aswanto.
